Welcome to Blue Wave Vacation Rentals. By making a reservation with us, you (the “Renter”) agree to be bound by these Terms and Conditions. This Agreement forms a legally enforceable contract between you and Blue Wave Vacation Rentals, LLC (“we,” “us,” or “Blue Wave”). It includes any unit-specific terms that apply to the property you reserve, which will be provided during the booking process. If you book through a third-party channel, additional channel-specific terms may also apply.

2. Reservations and Payment

  • Booking Process:
    Reservations can be made via our website or by contacting our customer service. Your reservation is confirmed only upon receipt of a confirmation email.
  • Payment:
    Payments must be made using a valid credit card. By submitting your payment, you confirm that you are either the account holder or an authorized user. Should any payment issues arise, we reserve the right to request alternative payment or additional verification.

3. Rental Policies

These general policies apply to all our rental properties. Specific details or additional guidelines for each property will be provided in your reservation confirmation.

  • Occupancy:
    The occupancy limits for each property are specified in your reservation details. You agree to adhere to these limits.
  • Vehicle Limits:
    Each property may have its own vehicle capacity. Please refer to your booking details for the specific limits.
  • Minimum Age:
    The minimum age to rent our properties is typically 25 years or as specified in your reservation. Proof of age may be required.
  • Property Use:
    Our properties are intended for temporary vacation stays only and should not be used as a permanent residence.
  • Good Neighbor Policy:
    You agree to treat the property with care and respect. Follow any house rules regarding noise, parking, and general conduct as outlined in your property-specific guidelines.
  • Responsible Renter:
    As the Renter, you are responsible for the behavior of all occupants during your stay. Any damage or breach of these Terms may result in additional charges.
  • Facilities Use:
    Please use the kitchen and other facilities responsibly. Specific cleaning and usage instructions will be provided for each property.
  • Smoking and Pets:
    Policies regarding smoking and pets vary by property. Refer to your reservation details for the applicable guidelines.

4. Cancellation and Refund Policy

  • Cancellations:
    Refund policies vary based on the timing of your cancellation relative to your reservation start date. Details will be provided at the time of booking.
  • Trip Protection:
    If you purchase Trip Protection, it may waive cancellation fees for covered reasons as specified in your reservation.

5. Maintenance and Housekeeping

  • The property is provided in “as-is” condition. Please report any issues promptly by contacting us using the information provided in your confirmation email. We reserve the right to enter the property for routine maintenance or emergency repairs with reasonable notice, except in cases of emergency.

6. Dispute Resolution and Governing Law

  • Arbitration:
    Any disputes arising from this Agreement will be resolved through binding arbitration in accordance with the American Arbitration Association’s Consumer Arbitration Rules, unless otherwise permitted by small claims court.
  • Governing Law:
    This Agreement is governed by the laws of the State of Texas, and any disputes will be handled in the appropriate Texas jurisdiction.

7. Limitation of Liability and Indemnity

  • Limitation of Liability:
    To the maximum extent permitted by law, Blue Wave Vacation Rentals, LLC. and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your rental.
  • Indemnity:
    You agree to indemnify and hold Blue Wave Vacation Rentals, LLC. harmless from any claims or damages resulting from your use of the property.

8. Substitution of Property and Assignment

  • Substitution:
    In the event that the reserved property becomes unavailable due to unforeseen circumstances, we reserve the right to substitute it with a comparable property. The same Terms and Conditions will apply.
  • Assignment:
    Blue Wave Vacation Rentals, LLC. reserves the right to assign this Agreement or delegate any responsibilities under it without prior notice.

9. Communication Process

At Blue Wave Vacation Rentals, we send SMS messages to provide you with essential booking updates and customer service notifications. The following outlines our SMS messaging service:

  • Message Types:

    • Informational Messages: These include booking confirmations, check-in instructions, reservation updates, and customer service alerts.
    • Promotional/Marketing Messages: We do not send promotional or marketing messages.

  • Message Frequency:

    • Depending on your booking status, you may receive messages daily as your check-in date approaches or weekly if your reservation is further in the future.

  • Data Rates Notice:

    • Message and data rates may apply.

  • Subscription Management:

    • To unsubscribe, text STOP to unsubscribe.
    • For assistance, text HELP for assistance.

By providing your contact information, you agree to receive SMS messages in accordance with the above terms.
